1. Object of the service:
www.electrosed.fr offers Internet users a hardware and software sales service. Once purchased and downloaded, the software can be installed on hard disk and used without time or reinstallation limit.
The Service is operated by Ai-Wave (ESPT S.A.R.L), registered in the Aubenas Trade and Companies Register under number 432 867 448.
With regard to software, it is specified that no physical support (cd-rom, dvd-rom, ...) will be sent. Internet users can in some cases download free demo versions (excluding connection costs) in order to check, among other things, the compatibility of the software with their hardware.
2. Responsibility and necessary IT equipment
Software weighing in some cases several hundred megabytes, it is advisable to download from a broadband line such as ADSL, fiber or cable.
As the software offered works on a PC, it is up to the customer to ensure that his computer complies with the minimum hardware configurations indicated online for each software presented.
With regard to hardware components that are not supplied "turnkey", it is the customer's responsibility to ensure that the components ordered on www.electrosed.fr are compatible with the hardware they already own. Ai-Wave cannot be held responsible for the improper use of the material ordered or the software downloaded, nor for their incompatibility with the customer's material.
3. Prices
The price of the products is fixed by Ai-Wave and is clearly displayed to the Internet user prior to his order.
The price of these products may be modified at any time by Ai-Wave, the price applicable to each order being the price in effect at the time of the order.
4. Purchase
4.1. payment methods
Payment is made by credit card or PayPal system.
No bank data is transmitted or stored by Ai-Wave or on the www.electroseed.fr website.
The sale is made by clicking on the "Validate" button.
4.2. Payment security
Purchases on the site www.electrosed.fr are secured by:
- SSL and TLS encryption technology which encrypts the transmission of information.
- the encryption functions of Internet Explorer, Mozilla Firefox or other browsers (according to the customer's choice).
- the secure online payment system which allows direct connection of the Internet user's computer to the Bank Card center for processing and authorization requests.
- the transaction is carried out according to the security standards of the banking sector.
In order to combat the resurgence of Internet fraud, Ai-Wave records IP addresses, as well as the exact dates and times of transactions. This unique and formal identification binds you contractually. In the absence of fraud, these elements will remain confidential.
4.3. Invoice and serial number for software
When the sale is made, a purchase confirmation email is sent to the customer. This email contains a link to the product order page. This page contains the invoice as well as the possible serial numbers necessary for the installation of the purchased software. It can be consulted at any time by the customer on the site www.electrosed.fr.
4.4. Right to retract
By downloading software from the www.electroseed.fr store, you expressly agree to waive the exercise of your right of withdrawal for fourteen clear days, pursuant to the provisions of article L.121-20-2 -4° of the Consumer Code which specifies that the said right of withdrawal cannot be exercised unless the parties have agreed otherwise, for contracts for the supply of audio recordings or computer software when they have been unsealed by the consumer. This also applies to material that has been customized for the customer.
No right of withdrawal can therefore be exercised for downloadable products and personalized material for the customer.
5. Access to the service
Download services are provided by www.electrosed.fr on a permanent basis, subject to maintenance operations, server updates and accidental interruptions.
6. Warranties
The liability and guarantee of www.electroseed.fr and Ai-Wave are limited to the replacement of products recognized as defective, excluding any compensation relating to ancillary costs and the granting of damages to any person whatsoever. either and in any capacity whatsoever.
7. Intellectual Property
In general, the Customer undertakes not to modify or infringe the title, trademark and intellectual property rights attached to the products purchased.
Downloading and paying for the software grants the Customer a non-exclusive individual license to use the software or software elements purchased. This license is granted for strictly personal, non-transferable and non-commercial purposes, for the legal duration of copyright protection.
A specific license may be provided with certain software or software items purchased.
The Customer agrees to respect the rights of authors and producers on downloaded software which are works protected by copyright and remain the sole property of their authors and producers.
Consequently, the Customer is prohibited from modifying, translating, adapting or copying the downloaded software unless a specific license agreement is offered with the software.
The Customer agrees not to reproduce, transfer, rent, resell, license or make use for commercial purposes of the software or elements of software purchased and downloaded on any medium whatsoever.
However, the Customer may make a reproduction on his own computer of the downloaded data with a view to their use for private and personal purposes as well as burning on CD-Rom or other medium exclusively for personal non-commercial archiving for backup purposes.
Please contact us if you wish to use one of our software commercially, for some of them we offer specific versions adapted to this type of use, as well as dedicated license agreements.
The free demo version, for its part, can be used without restriction, subject to not misusing it or misusing it which could cause harm to Ai-Wave or to the producers and authors of the software and subject to not being modified.
This demo version may not be used for commercial purposes without the express written permission of Ai-Wave or the software publisher.
8. Termination
Ai-Wave may refuse access to the Service to the Customer in the event of its violation of the conditions of use, in particular in the event of non-payment, or violation of the Intellectual Property Code.
9. Protection of personal data
Information concerning Customers collected by www.electroseed.fr and Ai-Wave will be treated with the utmost confidentiality in compliance with the Data Protection Act of January 6, 1978.
Customers have at any time a right of access, opposition and rectification of their personal data which they can assert either by sending an e-mail or by writing by registered mail to the publisher of the site at the next address :

10. Warning concerning the risks of epilepsy and the precautions to be taken when using software (Decree no. 96-360 of April 23, 1996 relating to warnings concerning software)
Some people are susceptible to epileptic seizures or blackouts at the sight of certain types of flashing lights or common elements in our daily environment. These people expose themselves to seizures when they play certain software.
These phenomena can appear even though the subject has no medical history or has never been confronted with an epileptic seizure. If you have ever exhibited symptoms related to epilepsy (seizure or loss of consciousness) in the presence of light stimulation, please consult your doctor before use.
In any case, please observe the following rules when using software:
- avoid playing if you are tired or sleep deprived.
- make sure you are playing in a well-lit room by moderating your screen brightness.

- during use, take breaks of ten to fifteen minutes every hour.
11. Jurisdiction - Applicable law
Any dispute arising from the application or interpretation of the conditions will be submitted to the Courts dependent on the Court of Aubenas and will be subject to French law.
